This Privacy Policy explains how we collect, use, disclose, and safeguard your information when you visit our website, use our mobile application, or engage with our services, including the Neuro-AI Assistant, Community Forum, Resource Hub, and Assistive Devices Store.
We are committed to protecting your privacy and complying with the Data Protection Act, 2019 (Kenya) and other applicable data protection laws. By using our Service, you agree to the collection and use of information in accordance with this policy.
2. Information We Collect
We collect specific types of data to provide our specialized services:
A. Personal Data (Identity & Contact)
Registration Details: Name, email address, phone number, and password when you create an account.
Profile Information: Your role (e.g., Caregiver, Neurodivergent Individual, Therapist) to personalize your experience.
Government Service Data (Redirection Only): Our platform provides informational guides and direct links to official government portals (e.g., eCitizen, NCPWD) to facilitate your applications. We do not collect, store, or process sensitive application data such as your National ID number, disability registration number, or financial details entered on those external government sites. Your interactions with those portals are governed by their respective privacy policies.
B. Sensitive Personal Data (Health Information)
Condition Details: Information regarding specific neurodevelopmental conditions (e.g., Autism, Cerebral Palsy, Epilepsy) you choose to share to receive personalized resources or community support.
Therapy Data: Information related to therapy needs if you use our “Service Provider Directory” to book or connect with specialists.
Note: We process this data strictly on the basis of your explicit consent and solely for the purpose of providing relevant support.
C. Neuro-AI Interaction Data
Chat Logs: When you interact with the Neuro-AI Assistant, your text inputs and queries are processed to generate responses.
Disclaimer: While we store chat history to provide context for your session, this data is anonymized for model improvement. Do not share identifiable sensitive health details (like patient names combined with medical records) in the AI chat.
D. Community & User-Generated Content
Forum Posts: Any information, stories, or photos you post on the “Neuro Afro Heroes” community forum or “Lived Experience Stories” section.
Privacy Warning: Information posted in public community areas is visible to other registered users. We urge caution when sharing sensitive personal details in public threads.
E. Transaction Data (Store)
Order Details: Products purchased, shipping address, and order history from the Assistive Devices Store.
Payment Info: We do not store your credit card or M-PESA PINs. Payments are processed by secure third-party gateways (e.g., M-PESA, Stripe, PayPal).
3. How We Use Your Information
We use your data for the following specific purposes:
Service Delivery: To provide access to the Resource Hub, personalized toolkits (IEPs, ADLs), and directory linkages.
AI Functionality: To enable the Neuro-AI to answer your questions accurately based on our knowledge base.
Community Connection: To facilitate peer support and connect you with relevant groups (e.g., “KE Special Needs Parents”).
Order Fulfillment: To process and deliver assistive devices you purchase.
Compliance: To fulfill obligations related to government-funded projects or reporting to partners like the NCPWD (only where legally required and typically with aggregated data).
4. Data Storage and Security
Location: Your data is securely stored on servers compliant with international data security standards (e.g., Google Cloud/AWS), with appropriate safeguards for data localization as required by Kenyan law.
Security Measures: We use encryption (SSL) for data in transit and robust access controls. Only authorized personnel (e.g., Andy Speaks Africa administrators) have access to sensitive user data.
Data Retention: We retain your personal data only as long as necessary to fulfill the purposes for which it was collected or to comply with legal obligations.
5. Sharing Your Information
We do not sell your personal data. We may share information only in the following circumstances:
Service Providers: With trusted third parties who assist us in operating the app (e.g., hosting providers, delivery couriers for the store).
Legal Requirements: If required by law, such as complying with a court order or a directive from the Office of the Data Protection Commissioner (ODPC).
Medical/Emergency: In extreme crisis situations where there is a risk to life (e.g., suicide prevention), we may share necessary information with emergency services.
6. Neuro-AI & Medical Disclaimer
Not a Doctor: The Neuro-AI Assistant is an information resource, not a medical professional. Its responses are based on our knowledge base but may not capture every nuance of your situation.
No Liability: We are not liable for actions taken based solely on AI responses. Always consult a qualified professional at Nexus Therapy Centre or a gazetted hospital for medical diagnosis and treatment plans.
7. Your Rights (Kenya Data Protection Act, 2019)
As a user in Kenya, you have the following rights:
Right to Access: You can request a copy of the personal data we hold about you.
Right to Rectification: You can update or correct your profile data at any time.
Right to Erasure: You can request that we delete your account and personal data (“Right to be Forgotten”).
Right to Withdraw Consent: You may withdraw your consent for us to process your health data at any time (this may limit your access to personalized features).
8. Children’s Privacy
While our services support children with special needs, our App and Web platform are intended for use by parents, guardians, and professionals. We do not knowingly collect personal data directly from children under 18 without parental consent.
